Since the period of tender has already been over, by efflux of time, the writ petition has become infructuous. However, liberty is granted to the petitioner to pursue his remedy with regard to refund of royalty before the appropriate forum in terms of detail tender call notice or the agreement executed between the parties, if he is so advised.

With the aforesaid liberty, the writ petition stands disposed of.
