This matter is taken up through virtual mode. 2.

The Petitioner apprehending his arrest in Nandankanan Police Station, Bhubaneswar under the district of Khurda as the staff of Nandankanan Police Station are regularly coming to his house and searching him for arrest.

However, the aforesaid cannot be a ground to come to a conclusion that the Petitioner is required in any case by the police.

As such, this Court is not inclined to entertain the prayer made in this petition.

Accordingly, the ABLAPL stands disposed of with a direction to the I.I.C., Nandankanan Police Station that if the Petitioner is required in any case of theft either as a witness or

// 2 // an accused, 48 hours notice under Section 160 of Cr.P.C. be given to him to appear before the police well ahead of such date and in that event, the Petitioner may approach this Court seeking pre-arrest bail, if so advised, if he is required as an accused.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout copy of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021 and Court's Office order circulated vide Memo Nos.514 & 515 dated 7th January, 2022.
