The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the proceeding in I.C.C. No.17 of 2011 pending on the file of the learned S.D.J.M., Rayagada. 3.

None appears for the petitioner. However, the learned counsel for the opposite party submits that the aforesaid proceeding has already been withdrawn. Report received from the Nyayadhikari-cum-J.M.F.C., G.N.K. At- Rayagada also reveals the same.

Be that as it may, since no one appears for the petitioner at the time of call and this case is of the year 2011 and one

// 2 // decade has already been passed from the date of filing of this case, this CRLMC stands dismissed for non-prosecution, inasmuch as the petitioner appears to be a recalcitrant litigant and has lost interest in the present litigation. 5.
