This matter is taken up through Hybrid arrangement (video conferencing/physical Mode). None appears on behalf of the petitioner.
Learned counsel for the State submitted that while the bail application of the petitioner is subjudiced before this Court, the petitioner has been granted bail by the learned Addl. Sessions Judge, Patnagarh on 04.05.2022.
On such submission, a report was called for from the Addl. Sessions Judge, Patnagarh.
In pursuance of such order, the learned Addl. Sessions Judge, Patnagarh has submitted the report from which it appears that in fact bail was granted to the petitioner by the learned S.D.J.M., Patnagarh and
// 2 // he has annexed the report of learned S.D.J.M., Patnagarh from which it appears that the learned S.D.J.M., Patnagarh was not made aware about the pendency of any bail application before this Court relating to the petitioner in connection with this case and taking into account the ground that the petitioner has already undergone more than half of the maximum period of imprisonment specified for the offences for which he has been charged, bail was granted taking recourse to the provision under section 436-A of Cr.P.C. Since the petitioner has already granted bail, this bail application stands disposed of. ( S.K. Sahoo) Judge P
