This matter is taken up through hybrid mode.

The Petitioner in this case has challenged the order under Section 144 of Cr.P.C. passed by the learned S.D.M., Bamanghati in Crl. M.C. No.52 of 2010.

In the meanwhile, the learned Magistrate must have become functus officio regarding the validity of the order under Section 144 of Cr.P.C.

No one appears on behalf of the Petitioner when the matter is called.

The defect is yet to be removed.

In such view of the matter, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for non-prosecution. (S. Pujahari) Judge DA
