Mishra, learned Additional Government Advocate contended that during the pendency of the writ petition, the opposite party no.1 has expired. However the tribunal vide impugned order has directed to constitute a review DPC to consider the suitability of opposite party no.1 for promotion to the cadre of Inspector. Since opposite party no.1 is no more, nothing more survives for adjudication.

In view of the above, the writ petition stands disposed of. So far as financial benefits of the deceased employee, if any is pending, it is open to the petitioner to provide the same to his legal representatives.
