ORDER (Oral) 22.03.2022 05.

1. This matter is taken up through virtual/physical mode.

2. The petitioner alleges that there has been violation of the order dated 06.06.2018 passed by this Court in W.P.(C) No.9562 of 2018, whereby the Collector, Balasore was directed to dispose of the representation of the petitioner in respect of Governmental authorities trying to construct a Community Centre over a plot of Nayanjori kisam, by passing a reasoned order after giving an opportunity of hearing to the petitioner.

3. Upon notice, an affidavit dated 17.03.2022 has been filed on behalf of the Contemnor/Opposite Parties. In the affidavit it is stated that the petitioner neither produced the certified copy of the order dated 06.06.2018 nor appeared for hearing, as directed by this Court. Still the Collector, Balasore got a joint enquiry conducted in compliance of similar direction issued in a similar writ petition filed by other residents of the village seeking an identical relief. Based on the joint enquiry report, an order dated

// 2 // 22.06.2019 already stands passed which also addresses the grievance of the petitioner.

Thus, learned counsel for the State submits that in sum and substance, the order passed by this Court stands duly complied with.

4. Upon hearing the parties and on perusal of the compliance report, we find no reason to continue with the present contempt petition.

5. The CONTC is accordingly dismissed.
