The defaulting borrower is before this Court, against whom recovery process under the SARFAESI proceeding has been initiated.

The only prayer is for directing the Urban Co-operative Bank Ltd., Gandarpur Branch, Cuttack for regularizing the business loan account by accepting the amounts overdue for regularizing the loan account.

Counsels for the parties are agreed that the present petition has become infrucutous in the light of the loan account having been upgraded to a regular account in view of the deposit of the amounts overdue.
