This matter is taken up through virtual/physical mode. 2.

Challenge in the writ petition is to demand notice dated 6th December, 2021 (Annexure-13) issued by the Superintendent of Excise, Sambalpur for the year 2019-2020 and 2020-2021 for falling to lift MGQ.

This Court issued notice vide order dated 24th February, 2022 and as an interim measure directed as follows:- "In the meanwhile, the demand raised in terms of the impugned memo dated 6th December, 2021 to the extent of 10% only shall remain stayed."

At the time of hearing today, Mr. L. Samantaray, Additional Government Advocate submits that a memo has been filed enclosing therewith copy of communication dated 26th February, 2022 of Superintendent of Excise, Sambalpur, whereby the demand notice dated 14th September, 2021 as well as revised demand notice dated 6th December, 2021 has been withdrawn.
