This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 24th May, 2011 passed by the learned C.J.M.-cum-Assistant Sessions Judge, Kalahandi at Bhawanipatna in Sessions Case No.74/27 of 2010 wherein his petition under Section 311 of Cr.P.C. has been rejected and the same has been confirmed by the learned District & Sessions Judge, Kalahandi/Nuapada at Bhawanipatna vide order dated 20th June, 2011 passed in CRLREV No.16 of 2011 and to direct the learned trial court to recall P.W. 3 for her further cross-examination. 3.

No one appears on behalf of the Petitioner at the time of call.

The case is of the year 2011.

As such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution. 7.

Interim order dated 8th August, 2011 passed by this Court in Misc. Case No.1533 of 2011 stands vacated. 8.

Order be communicated to the court concerned forthwith.
