1. In view of the order passed by this Court in Suresh Chandra Mishra v. State of Odisha (2016) 121 CLT 587, the Court permits the Petitioner to make a representation to the Opposite PartyAuthority for refund of MGQ and license fee for the period during which the Petitioner's shop had to be closed.
2. If such representation is made not later than 2nd January, 2023 the Secretary, Department of Excise will examine such representation and after giving the Petitioner hearing, dispose it of in accordance with law within a period of three months and communicate the order to the Petitioner within a week thereafter. If aggrieved by such order, it will be open to the Petitioner to seek appropriate remedies in accordance with law.
