Heard learned counsel appearing for the parties. Perused the Order No.

findings of both the courts below involving rejection of an application under Order 39 Rule 1 and 2 of the Code of Civil Procedure. For involvement of concurrent findings of fact undertaken by both the courts below, this Court is not inclined to entertain the C.M.P. Consequently, the C.M.P. stands dismissed. Petitioner if so advised may approach for expeditious trial of the matter.
