Heard Mr. A. Patnaik, learned counsel for the petitioner; Mr. P.K. Parhi, learned Assistant Solicitor General of India for opposite party no.1 and Mr. P.P. Mohanty, learned Additional Government Advocate for opposite party no.2.

It is contended that the petitioner was not heard at the time of hearing of the revision petition, but the revisional authority has passed the final order with some observations, which are prejudicial to the petitioner. 4.
In that view of the matter, it is open to the petitioner challenge the vires of Section 10-A(2)(a) of the Mines & Minerals (Development & Regulation) Act, 1957 and in the event he succeeds, he shall have the opportunity to participate in the said revisional proceeding. 5.
