1. This matter is taken up through hybrid mode. Order No.

2. Heard Mr. J.K.Panda , learned counsel for the Petitioners, and Miss.S. Mishra, learned Addl. Standing Counsel for the State.

3. This is an application under Section 482 of the Cr.P.C. The Petitioners are accused in C.T. Case No.271-A/2020 in the court of learned J.M.F.C, Kantamal.

4. Having regard to the fact that the grounds that have been raised before this Court, can also be raised before the court

// 2 // below, this Court is not inclined to interfere in the matter at this stage. It is, however, open to the Petitioner to raise all such grounds as are available to him in law before the court below by filing appropriate application at the appropriate stage.

5. It is further open to the Petitioners to move the courts below for bail and in such event, the same shall be considered on its own merit having due regard to the principle of parity since it is submitted that several co-accused persons have already been released on bail.

6. With these observations, the CRLMC is disposed of.

7. As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Notice No.4798, dated 15th April, 2021 and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
