1. Defect No.12(iii) as pointed out by the S.R. is ignored.
2. Heard Mr.Rout, learned Advocate for the Petitioner and Mr.Das, learned Additional Standing Counsel for the State.
3. The Petitioner has come up against order dated 18th December, 2021 of the learned J.M.F.C.(R), Balasore in 1CC No.16 of concerning offences under Sections 420/467/468/448/294/506/34 wherein the prayer to dispense his personal attendance under Section 205 of the Cr.P.C. has been rejected.
4. It is submitted that since a complaint case has been filed relating to civil dispute, the appearance of petitioner may be dispensed with.
5. Upon hearing both parties, I do not find any cogent reason in favour of the Petitioner to grant him the benefit of Section 205 of the Cr.P.C. The prayer is rejected.
6. Accordingly, the CRLMC is dismissed.
