02. 1. This matter is taken up through Hybrid Mode.

2. Ashok Kumar Pradhan, one of the L.Rs. of Surendra Pradhan, Ex-LDC of SDO, Sessions Judge, Athagarh, who stated to have died on 24.03.2018 has filed the present contempt with the averments that the order dated 23.03.2018 passed by this Court in W.P.(C) No.7666 of 2012 has not been complied with.

3. None has come present on behalf of the petitioner.

4. Mr. Saroj Kumar Das, Standing Counsel appearing for opposite party No.1 and Mr. M.K. Khuntia, learned counsel for the State by referring to the order dated 11.10.2018 passed by the office of the Accountant General annexed to the show cause affidavit dated 17.03.2020 filed by the Principal Accountant General, Odisha submit that the orders passed by this Court

// 2 // stand fully complied with. It is submitted that since late Surendra Pradhan had resigned from service with effect from 04.03.1961 after putting in 16 years, 7 months and 4 days only, i.e., less than 20 years, his claim for pension was not well founded. It is submitted that even otherwise the resignation entails forfeiture of service.

5. Be that as it may, we are satisfied that the orders passed by this Court are fully complied with.

6. In view of the above, the contempt proceedings are hereby dropped and the CONTC is accordingly disposed of.
