Heard Mr. K.P. Mishra, learned counsel for the Petitioner and learned State Counsel for the Opposite Parties. 3.

The petitioner has filed this writ petition seeking direction to the opposite parties to give him appointment in any Group-C post under Rehabilitation Assistance Scheme in terms of O.C.S.(Rehabilitation Assistance) Rules, 1990 and Amendment Rules, 2016 within a stipulated period.

In course of hearing, learned counsel for the petitioner stated that the petitioner may be permitted to file a fresh representation before the authority highlighting the grievances, and the same may be directed to be disposed of within a stipulated time taking into consideration the judgment of the apex Court in State of Madhya Pradesh v. Ashish Awasthi, 2021(II) OLR (SC) 1072. 5.

Considering the facts and circumstances of this case, but, however, without expressing any opinion on the merits of the case,

this writ petition stands disposed of with the direction that in case the petitioner, with regard to the grievance made in this petition, files a fresh comprehensive representation before the authority within fifteen days hence, the same shall be considered by the said authority taking into consideration Ashish Awasthi (supra), and pass appropriate order, as expeditiously as possible, preferably within a period of three months from the date of receipt of such representation along with the certified copy of this order. 6.

With the above observation and direction, the writ petition is dispose of.
