BLAPL No. 480 of 2022 Janaki Khuntia ....

Petitioner Mr. J. Sahoo, Adv.

Opposite Party Mr. P. Tripathy, Addl. Standing Counsel

CORAM:

JUSTICE SASHIKANTA MISHRA

ORDER

14.10.2022 1.

This matter is taken up through hybrid mode.

Order No.

11.

2.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

3.

The petitioner is in custody since 27.01.2020 in connection with Kabisuryanagar P.S. Case No.14 of 2020 corresponding to G.R. Case No.13 of 2020 pending in the Court of learned Addl. District & Sessions Judge, Kodala for the alleged commission of offence under Sections 302/201/34 of IPC.

4.

Considering the nature of allegations and the existence of materials prima facie in support thereof, I am not inclined to allow the prayer for bail, which is therefore, rejected. However, it is submitted by learned counsel for the petitioner that because of her long incarceration, her family properties are in danger of being dissipated and that she needs to be released to take urgent steps to prevent further loss to her properties.

5.

Considering the submissions as above, the bail application is disposed of with a direction to court in seisin over the matter to release the petitioner on interim bail for a period of two months from the date of her actual release on such terms and conditions as he may deem fit and proper to impose including the condition that the petitioner shall appear on each date of posting of the case before the court below. 6.

BLAPL is accordingly disposed of.

7.

Issue urgent certified copy as per rules.
