Aruna Kumar Samal v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
CRLMC No.167 of 2022 Aruna Kumar Samal ....
Petitioner Mr. Bijay Kumar Mohanty, Advocate -versusState of Odisha ....
Opp. Party Mr. P.K. Mohanty, Additional Standing Counsel
CORAM:
SHRI JUSTICE B. P. ROUTRAY
ORDER
26.4.2022 Order No.
04.
1.
Heard Mr. B.K. Mohanty, learned counsel for the Petitioner and Mr. P.K. Mohanty, learned Additional Standing Counsel. 2.
The order issuing NBW of arrest against the Petitioner dated 11th November, 2021 by the learned Sessions Judge, Jajpur in CT (Spl.) No.181 of 2018 has been challenged in the present application. 3.
As it reveals from the impugned order the Petitioner failed to appear before the trial court in spite of issuance of repeated summons. The Sessions Judge thus issued NBW of arrest against him. As such, I do not see any merit in the challenge to interfere with the order of learned Sessions Judge in issuing NBW.
4.
The CRLMC is dismissed.
5.
At this stage the Petitioner prays for liberty to surrender before the Sessions Judge.
6.
However, it is open for the Petitioner to surrender before the learned Sessions Judge and seek for bail.
7.
An urgent certified copy of this order be issued as per rules. ( B.P. Routray) Judge M.K.Panda
