The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the F.I.R. in Saheed Nagar P.S. Case No.170 of 2011, corresponding to C.T. No.1687 of 2013, pending on the file of the learned S.D.J.M., Bhubaneswar. 3.

Heard the learned counsel for the petitioner and the learned counsel for the State. None appears for the opposite party no.2.

Since the F.I.R. allegation discloses a cognizable offence, this Court is of the view that prayer made in this

// 2 // CRLMC is devoid of merit. Hence, this CRLMC stands dismissed.

However, in the meanwhile if the petitioner has been charge-sheeted, he may challenge the order of cognizance. 6.

A copy of this order be communicated to the Court below forthwith.
