This matter is taken up through Hybrid Arrangement (Virtual / Physical) Mode.

Heard learned counsels for the parties.

One Kartika Chandra Swain, father of the victim girl, had married twice. His first wife is Sandhya Rani Swain, whose natural daughter is the victim girl. Subsequently said Kartika Chandra Swain married to the present Petitioner, whose actual name was Ranjita Maharana. But said Ranjita Maharana changed her name as Sandhya Rani Swain. It is submitted that the present petitioner is the step mother of the victim girl and she was showing stepmotherly attitude to the victim girl in absence of her real mother. Therefore the victim girl left the house and ultimately reached to her real mother Sandhya Rani Swain, who is at present residing at

// 2 // Tiripur in the State of Tamil Nadu, and as of now the victim girl is residing with her natural mother there in Tamil Nadu. 4.

The Investigating Officer, after thorough investigation, rescued the victim girl and produced her before the learned J.M.F.C., Soro, where her statement has been recorded under Section 164, Cr.P.C. After production of the victim, as stated above, she has been residing with her own natural mother Sandhya Rani Swain at Tiripur in the State of Tamil Nadu and she is also prosecuting her studies there.

In view of such fact, there remains nothing to be decided in the present WPCRL. If the Petitioner is so anxious to know about the well being of her daughter (victim), she can proceed to Tiripur in the State of Tamil Nadu to know all about her. 6.

With the aforesaid observations, the WPCRL is disposed of. 7.

Urgent certified copy of this order be granted as per rules. ........................
