1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 12th July, 2021 in connection with Dasamantpur P.S.

Case No.46/2021 corresponding to G.R. Case No.46/2021 pending in the court of learned J.M.F.C., Dasamantpur for the alleged commission of the offence under Sections 147/148/302/307/324/ 325/294/354/506/149 of I.P.C.

4. It is submitted that the informant's family members were aggressors and the matter arose out of an entirely civil dispute. In course of assault by the members of the informant's family, one member from the other side also lost his life and in order to protect themselves, there was a counter assault by them.

5. Considering the nature of accusations and the fact that two persons have lost their lives coupled with the fact that prima facie there are materials to substantiate such allegations, I am not inclined to allow the prayer for bail at this stage, which is therefore rejected. It is open to the Petitioner to renew his prayer after examination of Prema Jani and Nilai Jani during trial. The court below is directed to expedite the trial.
