Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

It is alleged that while the victim girl had gone to bamboo bush to attend the call of nature, the accused lifted her and took her near a pond and sexually assaulted her. The victim is a minor girl, aged about 10 years.

Considering the statement of the victim recorded under Sections 161 and 164 of Cr.P.C. as also taking into account her tender age and the nature of accusations made against the petitioner, I am not inclined to allow the prayer for bail, which is therefore, rejected. It is however open to the petitioner to renew his prayer for bail after examination of the victim during trial. 5.
BLAPL is accordingly rejected.
