3. In the result, the Appeal is allowed. The judgment of conviction and order of sentence dated 11.05.2011 passed by the learned Ad hoc Additional District and Sessions Judge (F.T.C.), Jharsuguda in Sessions Trial Case No.14/19 of 2008 are hereby set aside. The Appellant is acquitted of the said charge.

// 2 // The Appellant-Mahendra Behera @ Kaira is stated to be on bail vide order dated 27.04.2015 passed in Misc. Case No.21` of 2015 arising out of JCRLA No.07 of 2012. He be set at liberty forthwith unless his detention is so required in connection with any other case by cancelling the bail bond executed by him.
