Heard Mr. B.P. Tripathy, learned Additional Government Advocate for the petitioner and Mr. N. Biswal, learned counsel for the opposite party. 3.

Challenging the order dated 07.02.2013 passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No. 2096 (C) of 2001, the petitioner-State has approached this Court in the present writ petition.

It has been contended by learned counsel for the opposite party that challenging the similar order passed by the Tribunal, the State had preferred W.P.(C) No. 14678 of 2008, which has been dismissed vide order dated 19.05.2010. Challenging such order, the state had preferred SLP (C) CC No. 11322 of 2011, which was dismissed vide order dated 18.07.2011. The opposite party being similarly situated applicant before the Tribunal, his case is covered by the order passed by this Court in W.P.(C) No. 14678 of 2008. 5.
