The matter is taken up through hybrid mode.

Heard Mr. R.C. Pradhan, learned counsel for the claimant - Appellant and Mr. G.P. Dutta, learned counsel for the insurer - Respondent No.2.

There is delay of 342 days in presenting the appeal and the grounds mentioned in paragraph 3 of the Miscellaneous Application are that, the Appellant was not aware of the negative order passed by the Tribunal and after coming to know about the same he preferred the appeal.

Upon hearing Mr. Dutta, learned counsel appearing on behalf of the insurer and considering such grounds taken in the application, the same are not found satisfactory and as such this court is not inclined to condone the delay in preferring the appeal.

The Misc. Case is dismissed. Consequently the appeal is dismissed on the ground of limitation.
