Heard Mr. G.K. Nanda, learned counsel for the petitioner and Mr. P.P. Mohanty, learned Addl. Govt. Advocate.

The petitioner has filed this writ application seeking direction to the opposite parties to give permission of extraction and transportation of sand from his own land bearing Plot Nos. 213 and 799 of Khata No.59, Plot No.803 under Khata No.8 and Plot No.804 without mentioning the Khata No. there. But the documents which have placed on record vide Annexure-1, the land has been recorded in the names of Secretary Dinabandhu Bidyapitha High School and Secretary, M.E. School.

Therefore, this Court is not inclined to entertain this writ petition. However, if any cause of action still survives, liberty is granted to the petitioner to pursue his remedy before the appropriate forum. 5.
