1. This matter is taken up through virtual mode.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 15th December,2020 in connection with Khantapada P.S.

Case No.396/2020 corresponding to C.T. Case No.1063/2020 pending in the court of learned J.M.F.C. (R), Balasore for the alleged commission of the offence under Section 302 of I.P.C.

4. It is alleged that the Petitioner killed the deceased by assaulting her with an iron pipe when she was residing in his house.

5. Having regard to the fact that some eye witnesses have stated about the complicity of the Petitioner, I am not inclined to allow the prayer for bail, which is therefore rejected.

6. It is open to the Petitioner to renew his prayer after examination of eye witnesses namely, Saraswati Das and Sasika Biswal during trial.
