This matter is taken up through Videoconferencing Mode. 2.

Heard Mr. Puspalaka, learned counsel for the Petitioner and Mr. Dash, learned AGA.

According to Mr. Puspalaka the Petitioner is aggrieved by the attempt of the authorities to demolish his OPOLFED Booth situated over Plot No.1845 (PT) under Khata No.856 (GA Department) in Unit-19, Mouza Baramunda, Bhubaneswar though the same was allotted to him vide order dated 30th July, 2019 under Annexure-7 issued by the Bhubaneswar Municipal Commission itself. He further submits that though protesting against such attempt, the Petitioner has filed a detailed representation before the Commissioner, BMC (OP No.2) dated 24th December, 2021 under Annexure-8 for redressal of his grievances, but till date nothing has been done in the matter. In such background, he submits that a direction may be issued to the Commissioner, BMC to take a decision on the above noted representation and in the interregnum, interest of the Petitioner may be protected.

Considering such submission and without expressing any opinion on the merits of the case, this Court directs the Opposite Party No.2-Commissioner, BMC to take a decision on the grievance petition of the Petitioner dated 24th December, 2021 enclosed as Annexure-8 to the writ petition in accordance with law within a period of eight weeks from the date of production of certified copy of this order and communicate the result of such exercise to the Petitioner.

Till a decision is taken is taken on the above noted grievance petition under Annexure-8 status quo as on today with regard to the OPELFED booth of the Petitioner shall be maintained.

Issue urgent certified copy of the order on proper application.
