This matter is taken up by video conferencing mode. 2.

By way of this writ petition the Petitioner has alleged that there is undertaking of construction over the homestead land of the Petitioner. Petitioner appears to have already made a complaint in this regard to the B.D.O, Mahanga vide Annexure-3 since 15.01.2022. 3.

Considering the submissions made by the learned counsel for Petitioner, this Court in disposal of the writ petition directs, in the event any such application at the instance of the Petitioner is still pending before the B.D.O, Mahanga, the same shall be disposed of by passing a lawful order involving the Petitioner and if necessary, undertaking a measurement exercise in presence of the Petitioner. 4.

The entire exercise shall be completed within a period of fifteen days from the date of communication of an authenticate copy of this order by the Petitioner.

The writ petition stands disposed of with the aforesaid observation and direction.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021 and Court's Office order circulated vide memo Nos.514 & 515 dated 7th January, 2022.
