Saroj Kumar Rout v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
ABLAPL No.788 of 2022 Saroj Kumar Rout and another ....
Petitioners -versusState of Odisha ....
Opposite Party CORAM: JUSTICE S. PUJAHARI Order No.
ORDER
11.02.2022 01.
1.
This matter is taken up through hybrid mode.
2.
The Petitioners apprehending their arrest in Kaptipada P.S. Case No.134 of 2021 registered for alleged commission of offences punishable under Sections 341, 294, 323, 354, 354-A, 354-D, 427, 379, 506 read with Section 34 of the I.P.C. and Section 12 of the POCSO Act, 2012, have filed this petition for their release on pre-arrest bail.
3.
Heard the learned counsel for the Petitioners and the learned counsel for the State.
// 2 // 4.
It appears that the Petitioners had earlier approached this Court in ABLAPL No.9678 of 2021, which was dismissed on merit vide order dated 27th September, 2021. 5.
Learned counsel for the Petitioners submits that since this Court granted pre-arrest bail to another accused, judicial propriety demands that this Court should review the aforesaid order dated 27th September, 2021.
6.
I am not inclined to do so.
7.
Accordingly, the ABLAPL stands dismissed.
8.
However, if this Court passes any order which is not acceptable to the Petitioners, they can approach the appropriate forum and submission should not be made by the counsel that this Court has not committed any judicial propriety. (S. Pujahari) Judge DA
