Appellant Mr. D. K. Panda, Advocate -versusDinesh Chandra Mishra ....
Respondent Mr. V. Mohapatra, Advocate
CORAM:
THE CHIEF JUSTICE JUSTICE R. K. PATTANAIK Order No.
ORDER
09.05.2022 07.
Misc. Case No.968 of 2011 & W.A. No. 593 of 2011
1. There is an inordinate delay of 110 days in filing this writ appeal.
2. The Court has perused the above application which seeks to explain the reasons for the delay in filing this appeal.
3. Having perused those reasons, it is seen that the explanation given therein is not convincing at all. It is only stated how the papers were 'scattered' and therefore, the delay in filing this writ appeal. It is not acceptable to the Court as a justification for the delay in filing this writ appeal.
4. Accordingly, the delay is not condoned and Misc. Case No.968 of 2011 is dismissed. Consequently, the appeal is dismissed.
5. The interim order passed earlier stands vacated. (Dr. S. Muralidhar) Chief Justice (R. K. Pattanaik) Judge S. Behera
