This matter is taken up through hybrid mode.

Heard Mr. S. Jena, learned Standing Counsel for School and Mass Education Department for the opposite parties.

The petitioner has filed this writ petition challenging the order dated 05.07.2013 passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No.2046(C) of 2013. 4.

Opposite party no.4 has filed counter affidavit, whereof paragraph nos. 2 and 3 read as follows:

"2.

That, it is humbly submitted that consequent upon the order passed by Hon'ble High Court of Orissa in W.P.C. No. 28598/13 dtd. 16.1.2014, the Zilla Parishad teachers including the petitioner who had been sent back to their parent School have been recalled vide this Office order no.500/ped/6.3.2014 and re already working as CRCC, till now. Copy of order dtd. 16.1.2014 is filed herewith as Annexure-D/4 and copy of order dtd. 6.3.2014 is filed herewith as Annexure-E/4.

That, it is further humbly submitted that since the petitioner has filed this wpc case to continue as CRCC and as he is continuing as CRCC this case no more holds good and prayer of the applicant only apprehension and no merits for consideration."

In view of the above, the relief sought, having been granted

to the petitioner, this Court is not inclined to interfere with the order dated 05.07.2013 passed by the tribunal in O.A. No.2046(C) of 2013. 5.

Accordingly, the writ petition stands disposed of in terms of the averments made in the counter affidavit.
