Heard Mr. B.K. Nayak, learned counsel for the Petitioner and Mr. P.K. Mohanty, learned ASC for Opposite Party - State. 2.

The Petitioner has approached this court against rejection of his prayer under Section 205 Cr.P.C. by the learned S.D.J.M., Bonai in the impugned order dated 10th January, 2022.

The Petitioner is the accused concerning offences under Section 420/467/468/471 of I.P.C.

It is submitted by the Petitioner that, since he is presently serving as Headmaster of a Government U.P. School, to avoid inconvenience of his official work he should be exempted from appearance in terms of Section 205 of Cr.P.C. 5.

Considering the nature of offences I do not see any merit in the submission of the Petitioner to exempt him from appearance under

205 Cr.P.C. only for the reason that he is serving as a Headmaster. Accordingly the CRLMC is dismissed.
