IN THE HIGH COURT OF ORISSA AT CUTTACK

W.P.(C) No.19595 of 2012 Sri Gopal Nayak ....

Petitioner Mr. P.K. Mohanty, Advocate -versusState of Orissa and others ....

Opposite Parties Mr. Debakanta Mohanty, A.G.A.

CORAM:

THE CHIEF JUSTICE JUSTICE R.K. PATTANAIK

ORDER

02.08.2022 Order No.

03.

1. The original record produced by Mr. Debakanta Mohanty, learned Additional Government Advocate shows that in Revision Case No.356 of 1987, Sri Kasinath Nayak, the father of the present Petitioner, who was the original lessor, was served on 12th August, 1987. The endorsement of such service of notice is there in the service return.

2. In that view of the matter, the only ground on which the order has been challenged viz., that the Petitioner's father was not issued a notice and was not heard by the Revisional Authority fails. In fact, the impugned order does show that submissions were made by Kasinath Nayak in reply to the show cause notice and that he was heard by the ADM.

3. Consequently, there is no merit in the present writ petition and it is dismissed as such. The interim order passed earlier in the present petition sands vacated.

4. Issue urgent certified copy of this order as per rules. (Dr. S. Muralidhar) Chief Justice (R.K. Pattanaik) Judge S.K. Guin
