ORDER

20.05.2022 04.

1. The challenge in the present petition is to an order dated 18th Order No.

May, 2013 passed by the learned S.D.J.M., Gunupur in ICC Case No.15 of 2012 declining the prayer made by the Petitioners under Section 205 of the Code of Criminal Procedure for exemption from appearance in the trial Court.

2. The offences under Section 498-A IPC, Petitioner No.1 is now a septuagenarian as is Petitioner No.2. Petitioner No.3 is stated to be the brother-in-law of the complainant's daughter and is staying in Bengaluru.

3. Considering these facts, it is directed that the Petitioners are permitted to appear before the concerned trial Court on 25th July, 2022 whereafter their presence may be exempted till as and when they are needed in the trial.

4. The petition is disposed of in the above terms. The interim order passed earlier stands vacated.

5. An urgent certified copy of this order be issued as per rules.

6. The Superintendent of the concerned Branch is directed to immediately communicate this order to the concerned Subordinate Court.
