Heard Mr. P.K. Mishra, learned counsel for the Appellants, Mr. P.K. Behera, learned counsel for Respondent No.1 and Mr. S.K. Sahoo, learned counsel for Respondent No.2 2.
Upon hearing all the parties and considering the grounds mentioned in the application, the delay in filing the appeal is condoned.

The I.A. is disposed of.

By the impugned order the claim application of the claimant was disposed of with nil award on the ground that the Appellant was absent on repeated calls.

Upon hearing all the parties, the appeal is disposed of by remanding back the matter i.e. Misc. Case No.72 of 2010 (MACT 72 of 2010) to 3rd MACT, Jagatsinghpur with a direction to dispose of the claim application in accordance with law after granting opportunity of
hearing to all the parties. The Appellants and all the Respondents are directed to appear before the 3rd MACT, Jagatsinghpur on 9th May, 2022, where-after the Tribunal shall proceed with the matter by fixing suitable dates. Since the matter is a year-old one, the Tribunal shall do well to dispose of the same within a period of six months from the date of appearance of all the parties.
