Mr. Behera, learned advocate appears on behalf of petitioner and submits, his client appealed to the police but they remained inactive. He draws attention to his client's appeal dated 4th December, 2021 to IIC, Ranpur PS regarding illegal and willful encroachment of his client's land and cutting of trees by contractor engaged by Executive Engineer, Nayagarh (RW) Division with help of the administration.

Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of State and submits, no cognizable offence was indicated. There is presumption that State is acting in public interest.

It appears, petitioner is aggrieved by State action. Petitioner must find remedy otherwise than complaining of police inaction if available in law.
