This matter is taken up through hybrid mode.

None appears for the Petitioner, when the matter is called. 3.
The Petitioner has assailed the refusal of the Assistant Executive Engineer (Mechanical), Jobra Workshop Sub-Division, Jagatpur, Cuttack, Opposite Party No.5, from accepting the joining report dated 20.08.2008 to resume his duty as N.M.R Watchman and for non-consideration of his representation ventilating his grievance.

A counter affidavit has been filed controverting the allegation made.

It is, inter alia, the stand of the Opposite Parties that the Petitioner, who was working as N.M.R. under Opposite Party No.5, left the job on his own volition without any permission and as such
he was not allowed to join, keeping in view the nature of functions being discharged by the Petitioner being that of a Watchman. 6.
Considering the assertion in the writ petition and the stand of the Opposite Parties in the counter, this Court does not find any merit in the writ petition.
