This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Nirakarpur P.S. Case No.16 of 2009 corresponding to G.R. Case No.436 of 2009 pending in the Court of learned S.D.J.M., Khurda for alleged commission of offences under sections 272/273/308/302/34 of the Indian Penal Code read with sections 47(a) and 52(A) of Bihar and Orissa Excise Act.
It is a case where charge sheet has already been submitted under sections 272/273/308/302/34

Learned counsel for the State on instruction submitted that four persons died and number of persons were also hospitalized on account of consuming spurious liquor.
In view of nature and gravity of the accusation against the petitioner, I am not inclined to release the petitioner on anticipatory bail.
Accordingly, the ABLAPL stands dismissed.
