The petitioner has filed this writ petition assailing the order dated 03.04.2012 passed by the Orissa Administrative Tribunal in O.A. No.800 (C) of 2005, by which the tribunal has denied to extend the benefit in favour of the petitioner, as he had approached the tribunal at a belated stage.

As it appears, the tribunal, vide order dated 03.04.2012, taking into consideration the judgment of the apex Court, observed that since the petitioner has approached the tribunal after 3 to 4 years and, as such, since the seniority has remained unchallenged for more than 3 to 4 years, it would not be just and proper to reopen the same after such long lapse of time. By so observing, the tribunal has dismissed the original application.

In the above view of the matter, this Court is not inclined to entertain this writ petition at a belated stage. Accordingly, the writ petition merits no consideration and the same is hereby dismissed. Ashok/Sukanta (DR. B.R. SARANGI) JUDGE (SAVITRI RATHO) JUDGE
