The petitioner is a defaulting borrower of a Term Loan availed for a sum of Rs.2 lakhs from the State Bank of India, Sadheipali ADB, District-Sundergarh on 7th July, 2008. The said loan account was declared NPA and SARFAESI proceedings initiated vide Demand Notice dated 12th January, 2012. The prayer in the present writ petition is for a direction to the Bank for settlement under the OTS Scheme. 3.
At the time of hearing, learned counsel for the parties are agreed on account of the loan account having been closed, the present writ petition has
// 2 // become infructuous. However, learned counsel for the petitioner has filed a Memo in Court today seeking permission for withdrawal of the Writ Petition as he has no instruction from his client. The Memo be kept on record.

In view of the Memo filed, the Writ Petition is dismissed as withdrawn.
