1. On the previous date i.e. on 30th September 2022, none appeared Order No.

for the Opposite Party. Today, despite a pass over, none again appears.

2. The present petition under Section 11(6) of the Arbitration and Conciliation Act, 1996 ('Act') seeks the appointment of an Arbitrator to adjudicate the disputes between the Petitioner and the Opposite Party arising out of an agreement dated 18th January, 2019.

3. Having heard learned counsel for the Petitioner and having considered the reply filed by the Opposite Party, this Court appoints Mr. Gautam Mukherjee, Senior Advocate of this Court, as the sole Arbitrator to adjudicate the disputes between the parties including their claims and counter claims. The arbitration proceedings shall take place under the aegis of the High Court of Orissa Arbitration Centre. It is made clear that all the pleas urged

by the Opposite Party in his reply will be permitted to be urged before the Arbitrator for consideration in accordance with law.

4. The arbitration petition is disposed of accordingly. A copy of this order be communicated to the Coordinator, High Court Arbitration Center and the learned Arbitrator forthwith.
