Undisputedly the application at Annexure-5 should come in dependant on encroachment proceeding keeping in view the clear provision in Section 8-A of the O.P.L.E. Act. For the admitted situation involved in this writ petition, this Court declines to entertain the request for considering settlement application vide Annexure-5 in absence of pendency of any O.P.L.E. proceeding. Petitioner, if so advised, may approach under appropriate law.

The writ petition stands disposed of with the observation made hereinabove.
