Mr. Sahoo, learned counsel prays for an adjournment on behalf of Mr. Mishra, learned counsel for the Petitioner. 3.

On perusal of order sheet, it appears that notice in limitation matter was issued on 12th March, 2010, but requisites for issuance of such notice was not filed. Accordingly, the matter was listed on 22nd September, 2010 before the Registrar (Judicial). A direction was made by the Registrar (Judicial) for filing of requisites for issuance of notice, which has also not been complied with, as yet.

In that view of the matter, I am not inclined to entertain the prayer made by learned counsel for the Petitioner. 5.

Accordingly, the RPFAM is dismissed for nonprosecution (K.R. Mohapatra) Judge s.s.satapathy
