The petitioners in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") have prayed for quashing of the order dated 08.06.2012 passed by the learned S.D.J.M., Jagatsinghpur in 1.C.C. No.88 of 2012 taking cognizance of the offences under Sections 323, 447, 448, 451/34 of IPC.

Heard the learned counsel for the petitioners and the learned counsel for the State, so also the learned counsel appearing for the opposite party no.2.

Considering the facts and circumstances of this case, this Court is not inclined to interfere with the impugned order of cognizance.

However, considering the nature of accusation and submission advanced on behalf of the petitioners, this Court observes that if the petitioners file a petition under Section 205 of Cr.P.C., the said petition for dispensing with the personal appearance of the petitioners shall be allowed. 6.
With the aforesaid order, this CRLMC stands disposed of. Interim order dated 14.08.2012 passed by this Court stands vacated.

A copy of this order be communicated to the Court below forthwith.
