This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode). Heard learned counsel for the petitioners and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Karanjia P.S. Case No. 15 of 2021 corresponding to C.T. Case No.44 of 2021 pending in the Court of learned S.D.J.M., Karanjia for alleged commission of offences under sections 385, 500, 34 of the Indian Penal Code read

// 2 // with section 66 (C) of the Information and Technology Act.

Learned counsel for the State submitted that he has not yet obtained the case diary. This matter was taken up on 22.02.2021 on which date the interim protection was granted to the petitioners and the learned counsel for the State was asked to produce the up-to-date case diary. The matter was again listed on 23.03.2021 and 29.04.2021 and the case was adjourned in order to enable the State counsel to produce the case diary. Today learned counsel for the State submitted that he has not received the case diary.

In view of the available material on record and after going through the first information report and since the learned counsel for the State is unable to produce the case diary, the interim order dated 22.02.2021 is made absolute.

Accordingly, the ABLAPL stands disposed of.

Urgent certified copy of this order be granted on proper application.
