This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The prayer in the writ petition is inter alia, to bring the petitioner to the work charge establishment w.e.f. 1.03.2009. 4.

On perusal of the record it is seen that while issuing notice this Court by order dated 3.07.2013 as an interim measure directed that, if the petitioner is working as NMR, he shall not be disengaged, till the next date. The said order was extended on 2.08.2013.

Learned counsel for the petitioner submits that he has to obtain up-to-date instructions as to whether the petitioner has got the relief prayed for in the writ petition for coming over to the work charge establishment.

Considering the nature of the litigation, this Court disposes the present writ petition giving liberty to the petitioner to approach this Court in the event he has any subsisting cause of action, which shall be considered on the basis of its own merit. 7.
