Heard learned counsel for the petitioners and learned counsel for the State.

This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Jeypore P.S. Case No.29 of 2021 corresponding to G.R.(V) Case No.23 of 2021 pending in the Court of learned Special Judge (Vigilance), Bhawanipatna for the commission of the alleged offences punishable under section 13(2) read with section 13(1)(b) and section 12 of the Prevention of Corruption Act.

Learned Addl. Standing Counsel for the Vigilance Department on instruction submitted that the petitioners have

// 2 // complied with the order of this Court dated 07.04.2022 and they have appeared before the Investigating Officer and cooperated with the investigation. However, he submitted that further interrogation may be necessary. Learned counsel further submitted that no custodial interrogation of the petitioners is necessary but the petitioners should cooperate with the investigation.

Learned counsel for the petitioners submitted that the petitioners are willing to cooperate with the investigation and appear before the Investigating Officer as and when required on receipt of the written notice.

Considering the submissions made by the learned counsel for the petitioners and the conduct of the petitioners in complying with the order dated 07.04.2022, the said order is made absolute subject to the petitioners appear before the Investigating Officer as and when required on receipt of the written notice, produce the documents if sought for and they shall not try to tamper with the evidence. Violation of any of the conditions shall entail cancellation of bail. The ABLAPL is accordingly disposed of.
