The defaulting borrower has challenged the auction notice dated 22nd July, 2021 (Annexure-4) fixing the date of auction of the secured asset on 10th August, 2021 as also the subsequent sale certificate dated 30th September, 2021 issued in favour of the auction purchaser-Shaikh Hapijullah (Opposite Party No.4). 3.

The present petition was filed as the DRT, Cuttack was not functional due to non-availability of the Presiding Officer. 4.

At the time of hearing, counsel for the Petitioner prays for permission to withdraw the present writ petition to enable the Petitioner to pursue his already filed SA No. 88 of 2021 seeking identical relief before the DRT, Cuttack as it is stated that upon joining of the Presiding Officer, the said DRT is fully functional.

In view of the above, the writ petition is dismissed as withdrawn with the aforesaid liberty.
